Return, Refund and Cancellation Policy

1. Purpose and Legal Nature of This Policy

This Return, Refund and Cancellation Policy forms an integral and binding part of the Terms of Use and applies to all Users, including enterprises, developers, Pharma Partners, and individual subscribers.

By purchasing, subscribing to, or using any paid Service on DrugSetu, you explicitly agree to this Policy.

2. No Return of Digital Services

DrugSetu provides intangible, digital, on demand services including SaaS platform access, API access, data queries and responses, digital dashboards, and datasets.

• There is no physical product.
• There is no concept of return under this Platform.
• Once access is granted, the Service is deemed fully delivered and consumed.
• Return requests are not applicable and will not be accepted under any circumstances.

3. Absolute No Refund Policy

DrugSetu operates under a strict, absolute, no refund policy. All payments are final, irreversible, and non refundable.

• Change of mind
• Accidental, mistaken, or unauthorized purchases
• Incorrect plan or pricing selection
• Partial usage or non usage
• Dissatisfaction with data, APIs, or performance
• Termination or suspension of account
• Failure to cancel before renewal
• Downgrades, plan changes, or feature removals
• API rate limit exhaustion or throttling
• Technical issues originating from your systems
• Business, commercial, or regulatory impact
• Force majeure or external events

4. Acknowledgement of Digital Consumption

• Access to APIs and data begins immediately upon successful payment.
• API calls and data access constitute instant digital consumption.
• Digital services cannot be returned, reversed, or reclaimed.
• Denial of refunds for digital services is reasonable, lawful, and industry standard.
• This acknowledgement is a material condition of purchase.

5. Subscription Cancellation Policy

• You may cancel your subscription at any time via your account dashboard or by written request to info@drugsetu.com.
• Cancellation stops future billing only.
• Cancellation does not trigger any refund.
• Access continues until the end of the current billing cycle.
• Any unused time, credits, or usage allowances are forfeited.

6. Auto Renewal and User Responsibility

• Subscriptions may auto renew by default unless cancelled in advance.
• You are solely responsible for monitoring renewal dates, managing billing preferences, and cancelling prior to renewal.
• No refunds will be issued for auto renewal charges, forgotten cancellations, internal approval delays, or payment failures on your side.

7. API Usage, Limits and Overages

• API plans may include usage limits, quotas, or rate thresholds.
• You are solely responsible for monitoring API usage.
• Usage beyond plan limits is billed as per the applicable pricing.
• Overage charges are non refundable, even if unintentional or accidental.

8. Payment Failures, Suspension and Collection

• DrugSetu may retry failed charges.
• Access to Services may be suspended or restricted.
• API keys may be temporarily or permanently disabled.
• Outstanding dues remain payable.
• Suspension or restriction due to non payment does not entitle you to refunds or credits.

9. Billing Disputes and Corrections

If you believe you were billed incorrectly due to a platform side technical error, you must notify DrugSetu within 7 days of the charge by emailing info@drugsetu.com.

DrugSetu may investigate and, at its sole discretion, issue a billing correction or a discretionary credit adjustment. Credits, if any, are not refunds, have no cash value, and are non transferable.

10. Pricing Errors and Typographical Mistakes

If incorrect pricing, typographical errors, display errors, configuration mistakes, or system mistakes occur, DrugSetu reserves the right to cancel or correct affected transactions, adjust charges accordingly, and suspend access where misuse is detected. Such corrections do not entitle users to refunds or compensation.

11. Chargebacks and Payment Dispute Abuse

• Initiating chargebacks or payment disputes without first contacting DrugSetu constitutes a material breach of the Terms of Use.
• Chargeback abuse may result in immediate suspension or termination of access.
• API keys may be permanently disabled.
• DrugSetu may recover costs, penalties, and fees imposed by payment processors.
• DrugSetu may submit transaction records, logs, and usage evidence to payment gateways and banks.

12. Third Party Payment Gateways

Payments are processed through third party providers such as Razorpay and Stripe. DrugSetu is not responsible for gateway downtime, network or bank failures, or duplicate charges caused by processors or intermediaries. Payment disputes related to gateway errors must be resolved directly with the provider.

13. Termination by DrugSetu

• DrugSetu may suspend or terminate your account for violation of Terms of Use, API abuse, data misuse, scraping, redistribution, license violations, legal or security risk, fraud, or suspicious activity.
• Termination does not entitle you to any refund, credit, or compensation.

14. Force Majeure

No refunds or credits will be issued for service interruptions caused by internet outages, cloud outages, government actions, regulatory shutdowns, natural disasters, or events beyond reasonable control.

15. Taxes and Government Levies

Prices may be exclusive of applicable taxes. Taxes once collected and remitted are non refundable. Users are responsible for compliance with applicable tax laws.

16. Policy Changes

DrugSetu may update this Policy at any time. Changes will be posted with a revised Last Updated date. Continued use of the Platform constitutes acceptance of the updated Policy.

17. Governing Law and Jurisdiction

This Policy is governed by the laws of India. Courts in Ahmedabad, Gujarat shall have exclusive jurisdiction.
